This English version is provided for convenience and informational purposes only. In the event of discrepancies or inconsistencies, the German version shall prevail and remain legally binding.

Terms and Conditions

1. Scope

These Terms and Conditions apply to all orders placed by consumers (Section 13 German Civil Code) through our online store Formwerk Töpferbedarf Berlin.

2. Conclusion of Contract

The presentation of products in the online store does not constitute a legally binding offer, but rather an invitation to place an order. By clicking the “Buy” button, you submit a binding offer to purchase the goods contained in the shopping cart.

Confirmation of receipt of the order is sent automatically by email immediately after the order is submitted. A purchase contract is only concluded once we confirm shipment by a second email or dispatch the goods to you.

3. Prices and Shipping Costs

All prices are final prices. In accordance with Section 19 of the German VAT Act (small business regulation), no VAT is charged. Shipping costs may apply in addition to the stated prices and will be displayed during the checkout process.

4. Delivery

Delivery is available within Germany and to the countries selectable in the online shop.

Unless otherwise stated in the respective product description, delivery takes place after receipt of payment within the stated delivery times.

In exceptional cases, delivery delays may occur. If this happens, we will inform you promptly by email.

5. Payment

The payment methods displayed during checkout are available in our shop (e.g. credit card, PayPal, Apple Pay, Google Pay, Shop Pay, bank transfer). The purchase price is due immediately.

6. Retention of Title

The goods remain our property until full payment has been received.

7. Right of Withdrawal

Consumers have a statutory right of withdrawal in accordance with our Withdrawal Policy. Details on returns can be found here: Return Policy.

8. Warranty

The statutory warranty rights apply. Claims for defects expire two years after delivery of the goods.

9. Liability

We are fully liable for intent and gross negligence. In cases of ordinary negligence, we are only liable for damages resulting from injury to life, body, or health, or for the breach of an essential contractual obligation (an obligation whose fulfillment is necessary for the proper execution of the contract and on whose compliance the buyer may regularly rely). In such cases, liability is limited to the foreseeable and typically occurring damage.

10. Dispute Resolution

We are neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.

11. Final Provisions

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). Should individual provisions of these Terms and Conditions be or become invalid, the remainder of the contract shall remain unaffected.
